General Conditions of Sale
- Purpose
These General Terms and Conditions of Sale (hereinafter referred to as “GTC”) govern the sales of products made on the website Les Vins de Kathleen Van den Berghe (hereinafter referred to as the “Site”), and are entered into between:
– The company Mines et Wines, SAS, with a capital of 20,000 euros, registered with the Tours Trade and Companies Register under number Tours B 899779144, whose registered office is located at 25 RUE DE MINIERE CHATEAU INGRANDES-DE-TOURAINE – 37130 COTEAUX-SUR-LOIRE, telephone number +33 2 47 96 94 30, email: admin@chateaudeminiere.com, intra-community VAT number FR07899779144 (hereinafter referred to as “the Seller”)
– And any natural or legal person wishing to make a purchase via the Site (hereinafter referred to as “the Buyer”) - Acceptance of the TermsThese Terms and Conditions apply to all sales of products made on the Site. The Seller reserves the right to modify these Terms and Conditions at any time. The applicable Terms and Conditions are those in effect on the date of the order. The Buyer declares that they have read and accepted these Terms and Conditions before placing their order. Confirmation of the order therefore constitutes acceptance of the General Terms and Conditions of Sale.
- ProductsThe products and services offered for sale are those listed on the Site. Each product is accompanied by a detailed description. The product photographs are as accurate as possible but cannot guarantee a perfect similarity with the product offered.
The Seller reserves the right to modify the assortment of products and services offered for sale on the Site at any time. - PricesThe prices of products and services are indicated inclusive of all taxes (TTC), excluding delivery costs. The amount of delivery costs is specified before confirmation of the order. The Seller reserves the right to modify its prices at any time, it being understood that the price appearing on the Site on the day of the order will be the only one applicable to the Buyer.
- OrderThe Buyer may place an order on the Site after creating a customer account. The order will only be validated after payment has been accepted.
The Seller reserves the right to refuse any order for legitimate reasons, particularly in the event of a supply problem, or in the event of a dispute with the Buyer regarding payment for a previous order. - PaymentPayment is made online by credit card or any other method offered on the Site at the time of the order. The transaction is immediately debited from the Buyer’s credit card after verification of the card details. The Seller reserves the right to suspend any order processing and delivery in the event of payment authorization refusal by officially accredited organizations.
- DeliveryThe products are delivered to the delivery address indicated by the Buyer when placing the order.
Any reasonable delay in the delivery of the products shall not give rise to the Buyer’s claim for damages or cancellation of the order.
In the event of missing or damaged products during transport, the Buyer must make all necessary reservations on the delivery slip upon receipt of said products. These reservations must also be confirmed in writing within five days of delivery, by registered letter with acknowledgment of receipt addressed to the Seller. - Right of WithdrawalIn accordance with current legal provisions, the Buyer has a period of fourteen (14) days from receipt of the products to exercise their right of withdrawal without having to provide a reason or pay a penalty.
Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.).
In this case, the Buyer is liable. Any damage to the product during this period may invalidate the right of withdrawal.
Return costs are the responsibility of the Buyer.
If the right of withdrawal is exercised, the Seller will refund the amounts paid within 14 days of notification of the Buyer’s request. - WarrantyAll products supplied by the Seller are covered by the legal guarantee of conformity provided for in Articles L.217-4 et seq. of the French Consumer Code and the guarantee against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.
In the event of non-conformity of a product sold, it may be returned to the Seller, who will take it back, exchange it, or refund it. All complaints must be made by post to the following address: 25 RUE DE MINIERE CHATEAU INGRANDES-DE-TOURAINE, 37130 COTEAUX-SUR-LOIRE or by email to contact@chateaudeminiere.com with a photo of the product and the invoice within 30 days. - Personal DataThe Seller, in the online sales process, is only bound by an obligation of means. It cannot be held liable for any damage resulting from the use of the Internet, such as data loss, intrusion, viruses, service interruptions, or other unintentional problems.
- Protection of MinorsBy confirming their order and the General Terms and Conditions of Sale, the buyer agrees to be at least 18 years of age on the order date.
- LiabilityAll elements of the Site are and remain the exclusive intellectual property of the Seller. No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual, or audio.
- Intellectual PropertyThe Seller reserves the right to collect personal information and data concerning the Buyer. They are necessary for order management, as well as for improving the services and information we provide. In accordance with the law of January 6, 1978, the Buyer has the right to access, rectify, and object to any personal information and data concerning them.
- Archiving – ProofThe Seller will archive purchase orders and invoices on a reliable and durable medium constituting a true copy. The computerized records will be considered by the parties as proof of communications, orders, payments, and transactions between the parties.
- Dispute ResolutionThese General Terms and Conditions are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing this, the French courts will have sole jurisdiction.
